In Florida there are different kinds of alimony like temporary, bridge-the-gap, rehabilitative, durational, lump-sum or permanent. Couples can negotiate the terms of the alimony award, including the type, duration, and amount of support. However, if you can’t agree, the judge will evaluate your circumstances and decide for you. Florida Legislature has passed a controversial bill (SB 1796) that does 2 things. First, it creates a presumption in favor of equal timesharing (50/50). Second, it would repeal court-ordered permanent alimony in previously modifiable agreements; and thus, leaving bridge-the-gap, rehabilitative, lump-sum and durational alimony for all divorces going forward. However, Governor DeSantis wrote in his veto letter the following: “If (SB 1796) were to become law and be given retroactive effect as the Legislature intends, it would unconstitutionally impair vested rights under certain preexisting marital settlement agreements.” To read further go to https://www.flgov.com/wp-content/uploads/2022/06/6.24.22-SB-1796-Veto-Letter.pdf.
